Is Dominion using the definition provided in the Virginia Environmental Justice Act to determine potential environmental impacts?

In response to stakeholder feedback, Dominion Energy is creating a generic facility-type comparison table for the EJ section of Dominion’s 2024 IRPThe table will address the possible environmental effects of constructing and operating different types of power generation facilities.   

The Virginia Environmental Justice Act (VEJA) does not create any new requirements for individual citizens or companies, like Dominion; rather, it requires the Commonwealth “to promote” environmental justiceThe Company plans to follow NEPA definitions when designing the table, which it believes are substantially similar to VEJA definitions.  Rather than spending time debating how to interpret VEJA definitions, without precedent or guidance from the Commonwealth, the Company believes use of well-established NEPA definitions for environmental effects will provide a common language for all parties considering environmental effects, leading to a more fruitful discussion of environmental justice in the 2024 IRP proceeding.
